Air Passenger Duty

Air Passenger Duty (APD) was originally introduced in 1994 as a two-tier tax on passengers departing from the UK. Changes to the tax mean it applies to all operators of aircraft over 5.7 tonnes or with more than 19 seats.

Chapman Freeborn offers a full fiscal representation service for all operations, both regular and occasional operators. We provide advice on the implications of the tax and its consequences on your operations.

Overseas operators must be registered in the UK and any operator without a fixed UK address must appoint a Fiscal Representative in order to comply with UK HMRC regulations. The regulations applicable to APD are complex with heavy penalties for non or incorrect payment, our experience will ensure you remain in compliance with the regulations.

Case study: ETF Airways

ETF Airways is a Croatian ACMI, and charter operator established in 2020 and certified in 2021.  Currently operating three Boeing 737-800 aircraft, the company quickly established a reputation for its high standards, providing a high-quality service that exceeds the expectations of its clients.

ETF Airways started operating services from the UK several years ago and quickly recognised that they would need an experienced fiscal agent to handle all Air Passenger Duty (APD) matters within this region. After receiving their certification in 2021, ETF Airways appointed Chapman Freeborn to act as this fiscal agent on their behalf.

Chapman Freeborn was selected from a pool of prospective companies due to both its experience in providing APD services to a variety of operators, and for its ability to offer comprehensive services at a competitive price.

On a monthly basis, ETF Airways advise Chapman Freeborn of the schedule for their UK departures, alongside the passenger loads. Chapman Freeborn’s APD team then contact the handling agents and confirm passenger loads, identify passengers who are not liable to pay APD, and prepare all the necessary documents. Chapman Freeborn then makes the necessary filings with the UK HMRC office on behalf of ETF Airways.
